Notification to the Secretariat of the Implementation Committee – Espoo Convention – on behalf of Balkanka Association, Sofia, Bulgaria

Dear friends,
My name is Dimiter Koumanov and I still have the honor to be responsible for the environmental protection activities of Balkanka Association, Sofia, Bulgaria.
I hope you remember our communication in 2019 related to the ecocatastrophe taking place in the region of Bosilegrad and Kyustendil municipalities at the border between Bulgaria and Serbia, concerning the pollution of the transboundary Dragovishtitsa River.
Hereby I would like to further inform you that the Result of our joint efforts back then is no more than Zero, because as of today the Podvirovi lead & zinc mine in the village of Karamanitsa – Bosilegrad is still working in the same environmentally harmful way and is still poisoning the tributaries to the transboundary Dragovishtitsa River.
If you remember, the surface water bodies’ pollution caused by this mine was in the focus of a Complaint from Balkanka Association lodged with the Implementation Committee back in 2019, which you can find in the attached file.
Three and a half years after our complaint was lodged with the Implementation Committee, the Podvirovi mine is still operating without even an EIA conducted under the relevant Serbian environmental legislation, let alone any EIA in a transboundary context in line with the Espoo Convention.
Flotation of the raw material is taking place and waste waters are still dumped directly into a small tributary to the Karamanichka River below the mine without any treatment whatsoever. The remains of the processed ore are stacked in the ravine of the same small tributary and are washed away after each and every rainfall only to get into the transboudary Dragovishtitsa River with the numerous drinking groundwater sources in the terraces along this river in the territory of Bulgaria. The water from Dragovishtitsa River is also used for irrigation in Bulgaria, of course.

As you can see, the pile of the processed ore is much, much bigger than it was back in 2019:
… which means that the production was expanded since the opening of the mine some 5 years ago without a Serbian EIA, and this also means that for the last three years the concerns and efforts of the Implementation Committee, we were kindly informed of in 2019, do not mean a thing.
Furthermore, both the Bulgarian and Serbian authorities are doing less than Nothing on the matter, apart from washing hands with some bilateral Memorandums signed already twice – in 2019 and this year, which obviously didn’t lead to any improvement of the performance of the mine at all.
The operation of the mine was allegedly stopped by the Serbian authorities somewhere in 2020, BUT the management of the mine obviously wasn’t impressed too much to hear about that and bother, and on 14.06.2022 the mine was still working…
All the actions taken by the competent authorities on both sides of the border have lead to only one thing – the mining operator’s belief that his enterprise is untouchable by any law and, if you ask us, he is obviously right.
In result he became so arrogant to allow himself and the security of the mine to even attack with big stones a team from the Bulgarian National Television we took to the mining area in June 2022 to shoot a TV report with an official permission from the Serbian authorities, when a TV Camera was broken and just by mere chance a few heads of the reporters were not.

In November 2021 a Study on the environmental impact of the Podvirovi mine was carried out by the Institute of Chemistry, Technology and Metals at the Serbian University in Belgrade. The results from the surface and ground water samples tested are horrific and still nobody pays attention – neither the Serbian, nor the Bulgarian environmental authorities.
Finally, the production activities of the other lead-zinc mine in the region of Bosilegrad – the Grot mine – which was also part of the original Complaint of ours, together with the same pollution of another tributary to the transboundary Dragovishtitsa River have been expanded and almost doubled in 2019, again without a Serbian EIA and without an EIA in a transboundary context as well.
But this is not a surprise to anyone – the fact that the Bulgarian Ministry of environment and water has timidly sent a humble letter of invitation under the Convention to the Serbian Ministry with no consequences and reaction from the Serbian party one more time.
And, obviously, the case was not only OK with the Bulgarian authorities again but, rather, it was just another opportunity and reason for both parties to sign the next non working bilateral Memorandum for cooperation in the field of environmental and water protection on both sides of the border.
Here is the letter of invitation of the Bulgarian party from May 2019, which received no answer from the Serbian authorities:
Now, as the devastating impacts on the watercourses in the region of Bosilegrad are only growing, the aim of this letter is not only to inform the Espoo Convention Implementation Committee that the actions taken insofar/if there were any real actions/ didn’t lead to any positive result, but to ask the Secretariat if we can be kindly advised on what to do next?
So our question now is – if there is anything nongovernmental organizations and local people on both sides of the border can do under the circumstances?
We believe that the case represents a huge threat to the sheer existence and meaning of the Convention and its governing body and, therefore, we hope that this time the actions taken on behalf of the Implementation Committee will prove the opposite – namely that the Convention means something.
We have no other hope, you know.
We remain ready for cooperation and to submit additional information, as well as to answer any questions that may be rised.

В изпълнение на програмата на Сдружението за спасяване на Българските реки и на хората от убийственото въздействие на Минното дело, ВЕЦ-овете и другите бедствия и ведомства у нас, във връзка с поетия ангажимент да помагаме на структурите на МОСВ и БД, и с мисията на сдружението за повишаване информираността на всички останали държавни органи с цел усъвършенстване на административния им капацитет за справяне с проблемите на околната среда и водите, рибарството и аквакултурите, риска от наводнения за населените места, пресушаването на питейни язовири и езера в национални паркове, изсичането на крайбрежна растителност, задръстването на речните корита с габиони и прочее неподходящи уреди, подкопаването на мостовете над реките, кражбата на речна баластра, пясък, други подземни богатства и метални полезни изкопаеми, строителството на Магисрали, Турски газопроводи и т.н., пресушаването и/или отравянето на подземни води, реки, езера, водопади и язовири, включително питейни, превръщането на държавата ни в Галактически Боклучарник и Лунен Пейзаж от дупки за мини, газови и петролни полета, незаконни баластриери и кариери, включително маскирани и като „Рибарници“, увреждането на сградния фонд и имуществото на гражданите в непосредствена близост до любимите на МОСВ баластриери, липсата на множество реки, неотразени в кадастъра, строителството на супер безсмислени нови Язовири и на Водопроводи от Дунава или до Перник, или Бургас, Усвояването и/или Покриването на речните корита в населените места, застрояването на всичките ни реки с тръби и баражи, включително в Натура 2000 зоните, контрола, охраната и опазването на Защитените Територии и защитените Натура 2000 зони най-вече от местното население, затлачването на язовири в Пояс I на СОЗ с кал и други произведения на изкуството на храносмилането, както и проблемите със замърсяването на реките в трансграничен контекст, в които България е както страна на произход в някои случаи, така и засегната страна в други,
и прочее Ваши иначе благородни инициативи, както и за избягване на нови наказателни процедури от ЕК, а също така и на нови досъдебни производства и съдебни дела срещу Ваши действия и/или бездействия, което вече е неизбежно…
Ви уведомявам, че можете да се запознаете с кореспонденцията на сдружение Балканка с изпълнителните комитети на някои конвенции на ООН и по-специално Конвенцията от Еспоо и Конвенцията за опазване и използване на трансграничните водни течения и международните езера.
Повод за представеното писмо е Фактът, че при посещение на мина Подвирови в района на Караманица – Босилеградско, екип на БНТ беше нападнат докато снимаше красотите, за които Вие си затваряте очите в благородно двустранно съревнование със Сръбското МОСВ, в което и двете М-ва сте завоювали първото място!
Кореспонденцията изпращаме и на предходното ръководство на М-вото, с надеждата те като се върнат обратно, да не правят същите грешки по темата за опазване на водите и да не си затварят очите за проблема в Босилеградско също така.
Специално за новото Ръководство на М-вото, което доста ново и неопитно в занаята, обръщаме внимание, че към писмото да ИК до Конвенцията от Еспоо сме прикачили и нашата жалба от 2019г., в която накрая има линк към супер подробното описание на замърсяванията и от двете страни на границата – действащи и бъдещи, за да се добие по-ясна представа за Катастрофата, която предстои в Кюстендилския край!
Затова препращаме кореспонденцията и до община Кюстендил.
ВАЖНО:
Обръщаме Ви внимание също така, че вече и в Сърбия започна сериозно раздвиждане по тематиката. Преди няколко дена районът на Босилеград беше посетен от Александър Йованович – Чута, народен представител в Сръбския парламент в момента, който е дългогодишен и голям приятел на Сдружение Балканка и има защо.
В комуникация със сръбските ни приятели от Движението „Одбранимо реке Старе Планине„, чийто съосновател и фронтмен е г-н Чута, се разбрахме за някои съвместни действия срещу Вашите и на съратниците Ви от сръбското М-во бездействия досега. Бъдещите ни съвместни действия срещу Вас засега ще запазим в тайна от Вас, за да са изненада като им дойде времето.
Без да храним особено големи надежди, иска ни се да вярваме също така, че и някои от нашите природозащитни организации също ще се посъбудят малко по темата и ще се включат на наша страна в битката с Вас!
